Terms of Service for www.hyperresilient.com

Hyperresilient, LLC ("we," "us," "our," or the "Company"), a Texas limited liability company, owns and operates the website located at www.hyperresilient.com (the "Site"). The Site provides informational and educational content as well as e-commerce services for the sale of merchandise. These Terms of Service ("Terms") govern your access to and use of the Site, including any content, functionality, products, and services offered on or through the Site. By accessing, browsing, or using the Site, or by placing an order, you agree to be bound by these Terms in their entirety. If you do not agree, you must immediately cease using the Site. We reserve the right to modify these Terms at any time in our sole discretion. Changes will be posted on the Site with an updated effective date. Your continued use of the Site after any changes constitutes your irrevocable acceptance of the revised Terms.

1. Use of the Site You may use the Site only for lawful, personal, non-commercial purposes and in strict accordance with these Terms. You agree not to:

  • Use the Site in any way that violates any applicable federal, state, local, or international law or regulation.

  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity.

  • Interfere with, disrupt, or attempt to interfere with or disrupt the Site, servers, or networks connected to the Site.

  • Attempt to gain unauthorized access to any portion or feature of the Site.

  • Use any automated means (including robots, spiders, scrapers, or data mining tools) to access the Site or extract data, except for public search engines with our prior written consent.

  • Upload, transmit, or distribute viruses, malware, or any harmful code.

  • Engage in any conduct that restricts, inhibits, or harms anyone's use or enjoyment of the Site, or that may expose us or others to liability.

We reserve the absolute right to terminate, suspend, or restrict your access to the Site, without notice or liability, for any reason or no reason, including any suspected violation of these Terms. The Site and all services are provided "AS IS" and "AS AVAILABLE." We may modify, suspend, or discontinue any part of the Site at any time without notice or liability.

2. Accounts To purchase merchandise or access certain features, you may be required to create an account. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update it promptly. You must be at least 18 years old or the age of majority in your jurisdiction to create an account or make purchases. We reserve the right to terminate or suspend your account at any time for any reason.

3. Orders and Purchases All orders are subject to our acceptance. We reserve the unconditional right to refuse, cancel, or limit any order for any reason, including but not limited to product availability, errors in pricing or description, suspected fraud, or violations of these Terms. Prices, product descriptions, and availability are subject to change without notice. We are not responsible for typographical or other errors. Payment is processed through Wix Payments. By placing an order, you authorize us to charge your provided payment method for the full amount, including applicable taxes, shipping, and other fees. Title and risk of loss for merchandise pass to you upon delivery to the carrier.

4. Shipping and Delivery Shipping rates are calculated at checkout. We may restrict shipping to certain locations at our discretion. Delivery times are estimates only. We are not liable for any delays, loss, or damage during shipping, or for any customs duties, taxes, or fees imposed by your country.

5. Returns and Refunds All sales are final. We do not accept returns or provide refunds except in cases of proven defects in the merchandise, at our sole discretion. To request consideration for a defect claim, contact support@hyperresilient.com within 7 days of receipt with photos and description. If approved, we may offer replacement or repair (no cash refunds). Shipping costs for defect claims are your responsibility unless we determine otherwise.

6. Intellectual Property All content on the Site—including text, articles, graphics, logos, images, videos, software, merchandise designs, and all informational and educational materials—is owned by us or our licensors and protected by United States and international copyright, trademark, trade secret, and other intellectual property laws. The informational and educational content on the Site is highly proprietary. No user or third party may copy, reproduce, distribute, modify, create derivative works from, publicly display, transmit, publish, scrape, data mine, or otherwise use any Site content or information—including for commercial purposes, training of artificial intelligence models, machine learning systems, competitive activities, or any other unauthorized purpose—without our express prior written permission. Any attempt to do so is strictly prohibited and will be pursued to the fullest extent of the law, including claims for damages, injunctive relief, and attorneys' fees. You are granted a limited, revocable, non-exclusive, non-transferable license to view the Site for personal, non-commercial use only. All other rights are expressly reserved. Any unauthorized use automatically terminates this license and may result in civil and criminal penalties.

7. User Content If you submit any content (e.g., reviews, comments, or submissions), you grant us a perpetual, irrevocable, royalty-free, worldwide, fully sublicensable license to use, modify, reproduce, distribute, display, and exploit it for any purpose without compensation or notice to you. You represent and warrant that your content does not infringe any third-party rights and complies with these Terms. We may remove or edit any user content at our sole discretion without notice.

8. Medical and Professional Advice Disclaimer THE SITE AUTHORS, OWNERS, OPERATORS, AND CONTRIBUTORS ARE NOT PHYSICIANS, MEDICAL PROFESSIONALS, OR LICENSED HEALTHCARE PROVIDERS. 12. Force Majeure We shall not be liable for any failure or delay in performance due to events beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, fires, floods, earthquakes, pandemics, supply chain disruptions, or governmental actions.

13. Governing Law and Dispute Resolution These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of laws principles. Any dispute, controversy, or claim arising out of or relating to these Terms or the Site shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in Travis County, Texas. You waive any right to participate in a class action, class-wide arbitration, or any consolidated proceeding. Judgment on the award may be entered in any court having jurisdiction. The arbitrator may award declaratory or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim. The prevailing party shall be entitled to recover its costs and reasonable attorneys' fees from the non-prevailing party.

14. Miscellaneous These Terms constitute the entire agreement between you and us regarding the Site. If any provision is held invalid or unenforceable, the remainder shall continue in full force. No waiver of any term shall be deemed a further or continuing waiver. We may assign these Terms at any time; you may not assign them without our prior written consent.
